Documents Required to Buy a Property in Gurgaon
Short answer
To buy a property in Gurgaon you mainly need the seller's registered title deed and prior chain, a non-encumbrance certificate, the approved plan and occupancy certificate, the HRERA number for under-construction units, and PAN plus ID of both parties for the sale deed and 1% TDS.
Start with the ownership trail. Ask the seller for the original registered sale deed, the chain of earlier title deeds (the mother deed), the latest mutation (intkaal) and, for plots or land, the jamabandi record of rights. Get a non-encumbrance certificate from the sub-registrar confirming the property is free of loans or dues, and for a built unit collect the DTCP or municipal approved building plan, the occupancy certificate and the completion certificate. These establish clear, marketable title before any money changes hands.
For the registry itself you need PAN and a photo ID (Aadhaar, passport or voter ID) for both buyer and seller, recent property tax and maintenance receipts, and a no-dues NOC from the society and from the seller's bank if the property was mortgaged. Stamp duty in urban Gurugram is 7% for men, 5% for women and 6% for joint male-female buyers, charged on the higher of the sale price or the Haryana collector (circle) rate, which was last revised with effect from 1 August 2025. The registration fee is slab-based and capped at a maximum of ₹50,000, which is the amount payable on any property valued above ₹90 lakh. If the sale consideration is ₹50 lakh or more, the buyer must deduct 1% TDS under Section 194-IA and file Form 26QB, so the PAN of both sides is non-negotiable.
What you collect depends on the stage. For an under-construction flat or builder floor, verify the HRERA Gurugram registration number on haryanarera.gov.in and keep the allotment letter, the builder-buyer agreement and all payment receipts. Under-construction homes also carry 5% GST with no input tax credit (1% for qualifying affordable housing, again without ITC), while a ready-to-move unit that has its occupancy or completion certificate is outside GST. For resale, the seller's registered deed, non-encumbrance certificate and tax receipts matter most. Registration appointments are booked through the Jamabandi Haryana portal, and you register at the sub-registrar for the property's jurisdiction with two witnesses carrying ID.
If you are an NRI or OCI buyer, add your passport, OCI or PIO card, and overseas plus Indian address proof, and pay only through an NRE, NRO or FCNR account or inward remittance, never cash. NRIs and OCIs can buy residential and commercial property in Gurgaon under the RBI general permission route without any special approval, but cannot buy agricultural land, farmhouses or plantation property. A registered power of attorney helps if you cannot be present for signing.
