Stamp Duty and Registration Charges in Gurgaon (Haryana)
Short answer
In Gurugram's urban limits, stamp duty is 7% for men, 5% for women and 6% for joint male-female ownership, charged on the higher of the sale price or the government circle rate. Registration is a slab fee capped at Rs 50,000. Rural rates are 5%, 3% and 4%.
In Gurugram's urban municipal limits, stamp duty is 7 percent of the property value for men, 5 percent for women and 6 percent where a man and a woman buy jointly. In rural or non-municipal areas the rates are 5, 3 and 4 percent. Registration is not a flat percentage in Haryana but a slab-based fee that rises with value and tops out at Rs 50,000 once the property crosses Rs 90 lakh, so on virtually any Gurgaon apartment, builder floor, plot or villa in the luxury range you simply pay the flat Rs 50,000.
Both charges are calculated on the higher of your actual transaction value or the government circle rate, also called the collector rate, for that sector and property type, so buying below circle rate does not reduce the duty you owe. Registering in a woman's name is the simplest legitimate way to lower the bill, cutting stamp duty from 7 to 5 percent, a saving of 2 percent of value against a sole male buyer; a joint male and female purchase brings it to 6 percent, a 1 percent saving. Treat these as costs on top of the price, not inside it.
Two other levies hit at purchase. GST applies only to under-construction homes bought from a builder, at 5 percent for standard units or 1 percent for affordable housing, both charged without input tax credit, with no GST on ready-to-move property that holds a completion certificate or on resale. Separately, when the price is Rs 50 lakh or more, the buyer must deduct 1 percent TDS on the amount paid to a resident seller under Section 194-IA and deposit it via Form 26QB; for an NRI seller, higher TDS on capital gains under Section 195 applies instead, filed on Form 27Q.
